How can I claim tax return from payroll mistakes done in the past year?

I am married but payroll company had me as single and it took me months to correct it. Therefore I got taxed as single. How can I claim the losses on my 2008 tax return?

  1. it doesn't matter during the year what you claimed on your W-4 at work. When you file your taxes, you claim your legal marital status and your deductions.
  2. So you had a larger withholding on your 2008 return. It isn't a loss you can claim.
  3. That's not a loss. You still owe the exact same amount of tax as you would have if they'd deducted the proper amount of withholding. Either they withheld too much, so you have to pay less out of your own pocket, or they didn't withhold enough, so you have to pay more out of your own pocket -- but either way, the absolute amount of tax you owe is non-negotiable.
  4. You will just file your taxes accordingly. What you should see is a large(r) refund because you would owe less in taxes because you're now married. So, you didn't take any losses... you will owe less and therefore get more back because of filing correctly (married).
